IMPORTANT — PLEASE READ CAREFULLY: By accessing or using The MORE Score assessment, website, or any related content, tools, or materials, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not access or use The MORE Score.

1. Overview and Acceptance of Terms

The MORE Score™ (“the Assessment”) is a behavioral intelligence and emotional awareness tool developed to help individuals better understand their thinking styles, communication preferences, and behavioral tendencies. It is designed to support personal growth, professional development, and improved relationships across a wide range of life areas.

These Terms of Use (“Terms”) govern your access to and use of The MORE Score website, online assessment platform, reports, content, and all associated materials (collectively, “Services”) provided by The MORE Score (“we,” “us,” or “our”). By accessing or using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Eligibility and User Responsibility

The MORE Score is designed for use by individuals of all ages. However, the following conditions apply:

• Users under the age of 13 must have verifiable parental or legal guardian consent before taking the assessment or submitting any personal information, in compliance with the Children’s Online Privacy Protection Act (COPPA) and applicable law.

• Users between the ages of 13 and 17 are encouraged to complete the assessment with the guidance of a parent, guardian, teacher, or certified MORE Score professional.

• By using the Services, you represent that you have the legal authority to agree to these Terms on your own behalf, or on behalf of a minor in your care.

You are solely responsible for ensuring that your use of the Services is appropriate for your age, circumstances, and needs.

3. Intellectual Property Rights

All content, materials, tools, methodologies, algorithms, scoring systems, profile frameworks, written materials, graphics, logos, and trade names associated with The MORE Score^SM are the exclusive intellectual property of The MORE Score^SM and are protected under applicable United States and international copyright, trademark, trade secret, and intellectual property laws.

This includes, but is not limited to:

• The MORE Score^SM name, logo, and branding

• The M-O-R-E behavioral profile framework and scoring methodology

• All assessment questions, scoring algorithms, and weighting systems

• Profile descriptions, reports, guides, and educational materials

• Website design, layout, code, and software

No portion of The MORE Score’s intellectual property may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, sold, licensed, or used in any way without our express written permission.

4. Prohibited Uses

By using the Services, you expressly agree that you will NOT:

• Attempt to reverse engineer, decompile, disassemble, decode, or otherwise derive the source code, scoring methodology, algorithm, or underlying structure of The MORE Score assessment or software

• Copy, reproduce, modify, adapt, translate, or create derivative works based on The MORE Score assessment, reports, or any associated materials

• Use The MORE Score^SM assessment, platform, content, or materials for any unauthorized commercial purpose without a valid license agreement

• Administer, distribute, sublicense, or resell The MORE Score^SM assessment to others without written authorization from The MORE Score^SM

• Use automated tools, bots, scrapers, or other means to access or collect data from the platform without written permission

• Attempt to bypass, disable, or circumvent any security features, access controls, or authentication measures of the platform

• Misrepresent your identity, credentials, or affiliation with The MORE Score^SM

• Use the assessment results to discriminate against any individual on the basis of race, gender, religion, age, disability, or any other protected characteristic

• Frame or mirror any portion of the website without our prior written consent

5. Authorized Use and Licensing

The MORE Score assessment may only be administered by individuals or organizations that meet one of the following conditions:

• The individual is taking the assessment for their own personal use and development

• The individual holds a current certification as an authorized MORE Score Coach, Trainer, or Consultant

• The organization has entered into a valid written License Agreement with The MORE Score

Certified MORE Score professionals and licensed organizations are subject to additional terms outlined in their respective Certification or License Agreements, which are incorporated herein by reference. Unauthorized administration of the assessment to third parties is strictly prohibited and may result in legal action.

6. Not a Medical or Clinical Assessment

IMPORTANT DISCLAIMER: The MORE Score^SM is a behavioral and educational assessment tool. It is NOT a medical device, clinical diagnostic tool, psychological test, or mental health evaluation. The MORE Score^SM does not diagnose, treat, prevent, or cure any medical condition, mental health disorder, learning disability, or psychological issue.

Results from The MORE Score^SM are intended solely for educational, personal development, and coaching purposes. They should not be used as a substitute for professional medical, psychological, psychiatric, therapeutic, or legal advice. If you have concerns about your mental health, emotional well-being, or any medical condition, please consult a licensed healthcare professional.

The MORE Score^SM profile results reflect behavioral tendencies and preferences at the time of assessment. They do not represent fixed personality traits, limitations, or clinical diagnoses. Individual results may vary and should be interpreted within context.

7. Data Collection and Privacy

By using the Services, you acknowledge that we collect the following personal information: your name, email address, and assessment results. This data is collected for the purposes of delivering your results, improving the Services, and communicating relevant resources and updates.

Your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in our Privacy Policy. We do not sell your personal information to third parties.

8. Assessment Results and Limitations

The MORE Score^SM provides a behavioral profile based on your self-reported responses. The accuracy of your results depends on the honesty and thoughtfulness of your answers. The MORE Score^SM makes no guarantee that results will be accurate, complete, or applicable to every situation.

Assessment results are provided for informational and educational purposes only. No employment, admission, placement, or legal decision should be made solely on the basis of MORE Score^SM results. We expressly disclaim any liability arising from reliance on assessment results for such purposes.

Behavioral profiles may evolve over time as individuals grow, develop, and experience life changes. Results from a prior assessment may not reflect current behavioral tendencies.

9. Disclaimer of Warranties

THE MORE SCORE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content provided through the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MORE SCORE^SM AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our total liability to you for all claims arising out of or relating to the Services exceed the greater of (a) the amount you paid us in the twelve (12) months prior to the claim, or (b) one hundred dollars ($100.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless The MORE Score^SM and its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of or access to the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; or (d) any content you submit or transmit through the Services.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Arkansas, and you consent to personal jurisdiction in such courts.

13. Modifications to the Services and Terms

We reserve the right to modify, suspend, or discontinue the Services at any time without notice. We also reserve the right to update or revise these Terms at any time. When we do, we will update the “Last Updated” date at the top of this document. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

14. Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to the Services at any time and for any reason, including but not limited to violation of these Terms. Upon termination, all licenses and rights granted to you under these Terms will immediately cease.

Sections 3 (Intellectual Property), 4 (Prohibited Uses), 6 (Medical Disclaimer), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), and 12 (Governing Law) shall survive any termination of these Terms.
